Terms of Service

1. Acceptance of Terms

By creating an account or using ActSciAI (the "Platform"), you agree to these Terms of Service. If you do not agree, do not use the Platform. These terms constitute a binding agreement between you and ThinkActuary (Pty) Ltd ("ActSciAI", "we", "us").

2. Description of Service

ActSciAI is an AI-assisted exam preparation platform for South African actuarial examinations. The Platform provides:

  • Practice questions aligned with actuarial examination syllabi
  • AI-generated feedback on written answers
  • An AI study co-pilot for concept explanation and practice question generation
  • Progress tracking and performance analytics

Important: ActSciAI is an independent study tool. AI-generated marks and feedback are indicative only and do not constitute official examination results.

3. Eligibility

You must be at least 16 years of age to use ActSciAI. By using the Platform you confirm that you meet this requirement. If you are under 18, you confirm that your parent or guardian has reviewed and agreed to these terms.

4. Account Registration

  • You must provide accurate and complete information when creating your account.
  • You are responsible for maintaining the confidentiality of your login credentials.
  • You are responsible for all activity that occurs under your account.
  • You must notify us immediately of any unauthorised access at legal@thinkactuary.com.
  • One account per person. Creating multiple accounts to circumvent usage limits is prohibited.

5. Subscription and Payment

  • Access to full features requires a paid subscription, billed at R1,200 per six months (or as otherwise stated on the Pricing page).
  • New accounts receive a 7-day free trial with full feature access.
  • Payment is processed by PayFast. By subscribing, you also agree to PayFast's terms of service.
  • Subscriptions are non-refundable except where required by the Consumer Protection Act 68 of 2008 or other applicable South African law.
  • We reserve the right to change pricing with 30 days' notice to existing subscribers.

6. AI Usage Limits

To ensure fair access and manage service costs, the Platform applies daily usage limits per account:

  • Live AI feedback: 30 calls per day
  • AI Co-Pilot messages: 20 messages per day
  • Final marking submissions: 5 per day

Limits reset at midnight (SAST). We reserve the right to adjust these limits. Attempting to circumvent limits through automation or multiple accounts will result in account suspension.

7. Intellectual Property

  • Practice questions are original works created for educational purposes and are not reproductions of any official examination materials.
  • The ActSciAI platform, design, code, and AI system prompts are the intellectual property of ThinkActuary (Pty) Ltd.
  • Your written answers remain your intellectual property. By submitting answers to the Platform, you grant us a limited licence to process them for the purpose of generating AI feedback.
  • You may not copy, scrape, reproduce, or redistribute any portion of the Platform without written permission.

8. Acceptable Use

You agree not to:

  • Use the Platform for any unlawful purpose or in violation of these terms
  • Attempt to reverse-engineer, scrape, or extract AI prompts or system architecture
  • Share login credentials with others
  • Use automated tools to interact with the Platform
  • Upload or submit content that is defamatory, offensive, or infringing
  • Attempt to gain unauthorised access to other users' data

9. Disclaimer of Warranties

THE PLATFORM IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND. TO THE MAXIMUM EXTENT PERMITTED BY SOUTH AFRICAN LAW, ACTSCIAI DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

AI-generated feedback, marks, and explanations are generated by machine learning models and may contain errors. We do not warrant the accuracy, completeness, or reliability of any AI-generated content.

10. Limitation of Liability

To the maximum extent permitted by law, ThinkActuary (Pty) Ltd's total liability to you for any claims arising from your use of the Platform shall not exceed the total amount you paid for the subscription in the 12 months preceding the claim. We shall not be liable for indirect, incidental, special, or consequential damages.

11. Termination

We may suspend or terminate your account at any time for material breach of these terms, with immediate effect. You may close your account at any time from the Settings page. Upon termination, your access to the Platform ceases and your data will be deleted per our Privacy Policy retention schedule.

12. Governing Law

These terms are governed by the laws of the Republic of South Africa. Any disputes shall be subject to the jurisdiction of the South Gauteng High Court, Johannesburg, without prejudice to your statutory rights as a consumer under the Consumer Protection Act.

13. Changes to These Terms

We may modify these terms at any time. For material changes, we will provide 14 days' notice by email. Continued use of the Platform after changes take effect constitutes acceptance of the new terms.
